It's never explained in the film how Pre-Crime can be legally implemented without trampling on the constitutional rights of the suspects. The suspects were all incarcerated without due process or a trial, which would violate their 5th and 6th Amendment rights. Prisoners being kept in status and forced to relive their crimes would violate their 8th Amendment rights.
