The first victim is killed by a poisoned cocktail. The glass is brought to him by another character--not the murderer. The first victim drinks from the glass before, during, and after the accusations, and the glass never leaves his hand after the second time. The murderer is never anywhere near it and therefore has no opportunity to put the poison in it.
