TCAS (Traffic Collision Avoidance System) alerts always supersede any ATC instructions, so when the flight reported the TCAS error, they should have followed the TCAS instruction and descended, THEN called it in. That way the controller could divert the other aircraft to ascend creating the required 1000 ft separation between aircraft occupying the same airspace.
