Once Kaffee confirmed with Markinson that Jessep had flight records changed in the tower chief's log, Kaffee didn't subpoena the tower chief to testify because as Sam states at 1:37 into the film, this wasn't a commercial airline therefore there wasn't a regular schedule, no one could keep track of flights that landed and took off several weeks ago.
