The circular-shaped bug being analyzed by the NSA is described as a "burst transmitter". Such a transmitter has a memory chip that stores data, which it then sent out in single bursts at very high speed. This is not the kind that would transmit the continuous signal that is seen on the congressman's hotel room. Also, this is the same prop that was used in Dean's shoes which, in that instance, was described as a location transponder. Also, the device is described as being built by a person. The nature of the construction reveals it to be a mass-manufactured item, not some limited-run in-house product.
