In the pre-4th of July montage, as crowds of beach-goers arrive on the island, Hooper and Brody are making phone calls to make sure the beaches are protected on the holiday. At one point Brody says, "I'm telling you we need Ben to patrol the swimming area." He is presumably talking about local fisherman Ben Gardner, whose damaged boat and severed head were revealed in a previous scene. So, Ben is already dead and Brody knows it since he discovered the boat and Hooper "discovered" Ben's head.
